These Terms of Service ("Terms") govern your access and use of the HyperSonic 2X application ("App") built on the Telegram platform ("Platform"). By using the App, you agree to be bound by these Terms and Telegram's Terms of Service (https://telegram.org/tos/terms-of-service-for-telegram).
1. Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are 18 years old or older and meet all the foregoing eligibility requirements.
2. Acceptable Use
You agree to use the App in a manner that complies with all applicable laws and regulations. You will not use the App for any purpose that is prohibited by these Terms or Telegram's Terms of Service. This includes, but is not limited to:
- Sending spam or unsolicited messages.
- Uploading or sharing content that is misleading, deceptive, or fraudulent.
- Violating any intellectual property rights of others.
- Disrupting the platform's functionality.
- Disrupting the flow of communication on the Platform.
3. User Content
You are responsible for all content that you upload, post, transmit, or otherwise make available through the App ("User Content"). You retain all ownership rights in your User Content, but by using the App, you grant HyperSonic 2X a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute your User Content in connection with the App and our services.
4. Third-Party Services
The App may integrate with or link to third-party services. You acknowledge that these third- party services are not under our control and are subject to separate terms and conditions. We are not responsible for the content or practices of any third-party services.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. HYPERSONIC 2X DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6. Limitation of Liability
HYPERSONIC 2X SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, AND SPECIAL DAMAGES.
7. Termination
We may terminate your access to the App for any reason, at any time, without notice.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with international trade law, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms will be resolved by binding arbitration in the International Chamber of Commerce (ICC) International Court of Arbitration.
9. Changes to the Terms
We may revise these Terms at any time by posting the revised Terms on the App. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes.
10. Entire Agreement
These Terms constitute the entire agreement between you and HyperSonic 2X regarding your use of the App.
